1. Overview
Bowling-Tournaments.com respects intellectual property rights and expects users of the Service to do the same. This policy describes how copyright owners or their agents may notify us of alleged copyright infringement on the Service under the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and how we may respond. This policy supplements our Terms of Service and Privacy Policy.
User-generated content on the Service may include, for example, tournament flyers; promotional banners; logos; profile images; standings; and other tournament-related media. If you believe your copyright in such material is being infringed, you may use the process described in this policy.
This policy primarily addresses copyright claims under the DMCA. Concerns involving trademarks or other intellectual property (for example, brand misuse or non-copyright disputes) may also be reported to support@bowling-tournaments.com; include enough detail for us to evaluate your concern.
If you are not sure whether material available through the Service infringes your copyright, you should consult an attorney. False or bad-faith notices may expose you to liability.
2. Designated copyright agent
DMCA notices regarding content hosted on or accessible through Bowling-Tournaments.com should be sent to our designated copyright agent at:
Bowling-Tournaments.com — DMCA notices
Email: support@bowling-tournaments.com
Please include “DMCA Notice” in the subject line. We may update this contact information from time to time by posting changes on this page.
3. What to include in a notice
To be effective under the DMCA, your notice should include substantially the following information:
- Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
- Identification of the material you claim is infringing (for example, a URL or description sufficient for us to locate the material on the Service).
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.
4. How we respond
When we receive a notice that meets applicable legal requirements, we may remove or disable access to the allegedly infringing material and may take other reasonable steps. We may also remove or disable access to content while we investigate infringement claims, where appropriate to protect rights holders and the integrity of the Service.
We may forward your notice to the user who posted the material. We may terminate repeat infringers in appropriate circumstances, as described below.
Nothing in this policy constitutes legal advice or a promise to take any particular action with respect to any notice or complaint.
5. Counter-notification
If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notification that complies with the DMCA (including your contact information, identification of the material and its location before removal, a statement under penalty of perjury, consent to jurisdiction if applicable, and your signature). Send counter-notices to the designated agent email above with “DMCA Counter-Notification” in the subject line.
If we receive a valid counter-notification, we may replace the removed material or cease disabling it unless the copyright owner seeks a court order against the user, as required by applicable law.
6. Repeat infringers
It is our policy, in appropriate circumstances and at our discretion, to disable or terminate accounts of users who are repeat infringers of copyright or other intellectual property rights. Bowling-Tournaments.com reserves the right to suspend or permanently terminate accounts that we associate with a pattern of repeated intellectual property violations, in addition to any other remedies available under our Terms of Service.
7. Misrepresentations
Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing—or that material was removed by mistake—may be liable for damages, including costs and attorneys’ fees.
8. Changes and contact
We may update this policy from time to time by posting a revised version on this page and updating the “Last Updated” date. Continued use of the Service after changes become effective constitutes your acknowledgment of the revised policy.
